بیانیه "کمیته بین المللی وکلای مدافع حقوق بشر" در ارتباط با بازداشت پنج وکیل دادگستری
صبح روز گذشته سه وکیل دادگستری ایرانی، در فرودگاه بین المللی تهران خودسرانه و برخلاف ابتدایی ترین اصول حقوقی توسط مامورین امنیتی بازداشت و به بازداشتگاه 209 زندان اوین منتقل شده اند. به گفته دولت آبادی دادستان تهران، دو وکیل دیگر نیز امروز در همین ارتباط بازداشت و به محل نامعلومی منتقل شده اند. هاجر( سارا) صباغیان، مریم کرباسی و مریم کیان ارثی، وکلایی هستند که روز گذشته به هنگام بازگشت از ترکیه، در فرودگاه بین المللی تهران بازداشت شده اند. این اقدام خودسرانه ماموران امنیتی در حالی انجام می گیرد که برابر ماده 117 قانون آیین دادرسی کیفری، تنها در دو هنگام می توان متهمی را بدون احضار کتبی بازداشت کرد. نخست آن که فرد، متهم به ارتکاب جرایم سنگینی شده باشد که مجازات قانونی آن ها قصاص،اعدام و قطع عضو است و دیگر آن که محل اقامت و شغل او معلوم نبوده و اقدامات دستگاه تعقیب نیز برای دست یابی به او به نتیجه ای نرسیده باشد. بی تردید هم محل اقامت و شغل بازداشت شدگان فوق در مقام وکلای دادگستری مشخص بوده و هم جرایمی که دادستان تهران آن ها را متهم به آن کرده، در زمره ی جرایمی نیست که مجازات اعدام و یا قصاص داشته باشد. لذا بازداشت شبانه وکلای دادگستری در تهران نه تنها مغایر موازین و استانداردهای بین المللی است، بل که با قوانین داخلی خود جمهوری اسلامی نیر منافات دارد. "کمیته بین المللی وکلای مدافع حقوق بشر" با تاکید بر این اصل حقوقی که هیچ فردی را نمی توان خود سرانه و بدون ادله کافی، دستگیر و بازداشت کرد، دستگیری جمعی و غیر قانونی وکلای دادگستری در ایران را شدیداً محکوم می کند و خواستار آزادی بدون قید و شرط تک تک آن ها می باشد. "کمیته بین المللی وکلای مدافع حقوق بشر" همچنین از هیات مدیره ی کانون وکلای دادگستری ایران می خواهد تا بیش از این نسبت به سرکوب گسترده وکلای دادگستری، سکوت نکنند و به مثابه یک نهاد مستقل صنفی، عهده دار ابتدایی ترین وظایف خود باشند. این کمیته همچنین از کانون بین المللی وکلای دادگستری می خواهد تا هر چه سریع تر با اعزام گروهی مستقل از وکلای دادگستری به ایران، اقدامات لازم به منظور پیگیری وضعیت وکلای زندانی ایرانی انجام دهد. از کمیته و کمیساریای عالی حقوق بشر سازمان ملل نیز می خواهیم تا نسبت به روند سرکوب وکلای دادگستری در ایران، موضع ای شفاف و قاطع داشته باشند و اجازه ندهند هیات های اعزامی جمهوری اسلامی با نام و عنوان حقوق بشر بیش از این در محافل بین المللی، وجدان های آزادی خواه جهان را به سخره بگیرند. این کمیته همچنین از تمامی سازمان ها و نهادهای بین المللی حقوق بشری و نیز کانون های وکلای دادگستری تمام کشورها می خواهد تا در برابر روند سازمان یافته و شرم آور سرکوب وکلای دادگستری در ایران ساکت نباشند و حاکمان ناقض حقوق بشر در ایران و نیز نمایندگان رسمی این دولت در خارج را مورد بازخواست های خود قرار دهند. Certainly, Residence and occupation of victims were obvious however, Tehran's prosecutor was not in duty and had not responsibility to arrest them while he would have known their locations and identities. Therefore, prosecuting of lawyers is not only contrary to international rules of total Islamic Republic of Iran, of course it is contrary to international standards of human rights and it is against the law. Furthermore, International Committee of Lawyers for Human Rights, emphasizing that any one has no right to arrest illegally,arbitrary without any reason detained friendly court, lawyers have drawn and have transferred to prison custody by the magistrate court security. Thus,International Committee of Lawyers for Human Rights board member of the Bar Association of Justice are wondering to put pressure to react the lawyers of the freedom of security and judicial.] The Committee of the Bar Association also wants to International Justice faster international group of lawyers to prevent unlawful pressure on Iran to deploy lawyers and judicial authorities not to allow companions and judicial system to take their security also not to put them under pressure of judicial issues. The committee of the Commission and the UN Human Rights wants to intervene as soon as possible and not allow violations of human rights delegation led by Larijani,according to the UN grounds and evidence, a number of investigators, the Ministry of Information including intelligence and security prison are transmitters of torture under international responsibility to shrink. The Committee of all organizations and international institutions and human rights lawyers focal wants other countries to violate human rights than Iran, tolerance, and tolerance and has not seriously violate the human rights of rulers in the Islamic Republic of Iran.
